These terms govern your use of the website at www.wellpal.io, the WellPal waitlist, and Ai4RD — the research preview at /ai4rd. Together we call these “the Services”. They do not cover the WellPal iPhone app, which is not released; when it ships it will carry its own terms, and your agreement with Apple will govern the purchase itself.

The Services are operated by WellPal, established in the United States. Full identity and contact details are on the Legal Notice page.

By using the Services you accept these terms. If you do not accept them, please do not use the Services. If you are using Ai4RD in the course of professional practice, you accept them both personally and on behalf of the organisation you act for.

This is the most important section on this page. Read it before you use Ai4RD.

• Ai4RD is a research preview. It is an experiment in whether a language model can help organise rare-disease differential reasoning. It is not a finished product and it is not a clinical system.
• Ai4RD is not a medical device. It is not FDA-cleared or approved, not CE-marked, not UKCA-marked, and not registered with any regulator in any jurisdiction.
• Ai4RD does not diagnose, and it does not provide treatment guidance. It does not practise medicine, and using it creates no doctor–patient relationship and no professional relationship of any kind with us.
• Ai4RD is not a HIPAA-covered service. We are not a covered entity and not a business associate, and we have no business associate agreement with you. Do not enter protected health information.
• Ai4RD output is generated by a language model. It can be wrong, incomplete, outdated, or fabricated, including citations that look authoritative and are not. Verify everything against primary sources before it informs any decision.

If you are a clinician

Ai4RD is an adjunct to your own reasoning and never a substitute for it. You remain solely responsible for every clinical decision you make, for independently reviewing the basis of any output you rely on, and for compliance with your own professional, regulatory and data-protection obligations — including not entering identifiable patient data into a service that is not covered by an agreement with you.

If you are not a clinician

Ai4RD’s patient mode exists to help you organise questions to ask a clinician. It is not a second opinion, not a diagnosis, and not a reason to change, delay or stop any treatment. Speak to a qualified healthcare professional about your own health.

Emergencies

Do not use Ai4RD in an emergency. If you or someone else may be in danger, contact your local emergency number or go to an emergency department. In the United States call or text 911, or 988 for the Suicide and Crisis Lifeline. In the EU and UK call 112, or 999 in the UK. Ai4RD is not monitored by a person, cannot summon help, and nothing you type into it reaches anyone who can respond.

Ai4RD’s responses are generated by a large language model, not written or reviewed by a person. There is no clinician, no researcher and no moderator reading your session. We say this here, and on the Ai4RD surface itself, because you are entitled to know it before you decide what weight to give an answer.

The model runs through a third-party inference provider, and searches run through a third-party search provider. Which providers, and what reaches them, is set out in the Privacy Policy.

You must be 16 or older to use this website, to join the waitlist, or to use Ai4RD. Ai4RD is intended for adults: clinicians in doctor mode, and adults organising questions for a clinician in patient mode.

We do not knowingly collect personal data from anyone under 16. If you believe a child has provided us with personal data, write to privacy@wellpal.io and we will delete it.

Doctor mode is not gated by credential verification. Selecting it is your representation that you are a licensed healthcare professional acting within your scope of practice. It does not change what the service is, and every limit in §II applies to it in full.

You agree not to use the Services to:

• enter identifiable information about another person — including protected health information, and including a patient’s name, exact dates, contact details, or record numbers;
• obtain guidance you intend to act on without independent professional judgment;
• attempt to make the model produce treatment instructions, dosing, or anything presented as a diagnosis;
• break, probe, overload or circumvent any technical limit, rate limit, or access control, or use automated means to access the Services;
• resell, redistribute or present the output as a clinical product, a regulated service, or the work of a human clinician;
• do anything unlawful, or anything that infringes someone else’s rights.

We may rate-limit, suspend or block access to the Services at any time to protect the service, its cost, or other users. Ai4RD runs on a shared budget and may be unavailable without notice.

You keep whatever rights you have in what you type into Ai4RD. You grant us only the permission we need to operate the service: to transmit your messages to the inference and search providers that generate a response, and to return that response to you.

We do not sell your content, and we do not use it to train models. We instruct our inference provider to route only to providers that do not use submitted content for model training. Ai4RD sessions are stored in your own browser, not on our servers — clearing your browser data clears them.

You are responsible for what you enter. Do not enter anything you are not entitled to share.

Joining the waitlist means we will email you when WellPal is released, and about the release. It is not a newsletter, not a subscription, and not a purchase. It creates no obligation on you and no entitlement to the app, to a price, to a place in a queue, or to a launch date.

You can leave at any time by writing to privacy@wellpal.io — that is the mechanism today, and it is a person, not a queue. Every email we send will also carry a one-click unsubscribe link. Leaving deletes your address from our store rather than flagging it as inactive.

Anything we say about when WellPal will be released, what it will contain, or what it will cost is a present intention, not a promise. Release dates move and features change.

The site, its text, its design, its code and the WellPal and Ai4RD names and marks belong to us or to our licensors. You may read, quote and link to this site normally.

The brand assets offered on the press page may be used for news reporting, reviews and commentary about WellPal. Please do not alter the mark’s colour, proportions or orientation, do not use it as your own identifier, and do not use it in any way that suggests we endorse you or that you are affiliated with us. We may ask you to stop, and if we do, please stop.

Ai4RD cites external sources, and its library lists links selected by an automated search. Those pages are not ours. We do not control them, we do not review them individually, and listing one is neither an endorsement of it nor a warranty that it is accurate, current or appropriate for your purpose. Judge them as you would any other source.

The Services are provided as they are, when they are. Ai4RD is a preview running on a shared budget: it may be slow, may be unavailable, may return errors, and may be withdrawn or changed at any time without notice. Nothing here promises uptime.

We may change these terms. When a change is material we will update the revision date on this page and, where the change affects your rights, say what changed rather than editing quietly. Continuing to use the Services after a change means you accept the revised terms.

To the fullest extent the law allows, the Services are provided “as is” and “as available”, without warranty of any kind, whether express, implied or statutory — including any implied warranty of merchantability, fitness for a particular purpose, accuracy, non-infringement, or that the Services will be uninterrupted, secure or error-free. We do not warrant that any output of Ai4RD is accurate, complete, current, or suitable for any clinical or personal decision.

Read both halves of this section. The second half matters as much as the first.

What we limit

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to the Services — including any decision made or not made on the basis of Ai4RD output. Because the Services are provided free of charge, our total aggregate liability to you for all claims relating to them is limited to one hundred United States dollars (USD 100).

What we do not limit

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that the law does not permit us to exclude or limit.

If you are a consumer, nothing in these terms affects your mandatory statutory rights under the law of your country of residence. Where those rights conflict with anything here, those rights prevail, and the rest of this section still applies as far as it lawfully can.

If you use the Services in breach of §V — in particular by entering another person’s identifiable or health information, or by presenting output as clinical advice — you agree to indemnify us against claims, losses and reasonable legal costs arising from that use. This does not apply to consumers acting outside a trade, business, craft or profession, to the extent your local law says it cannot.

These terms are governed by the laws of the State of New York and the federal laws of the United States, without regard to conflict-of-laws rules. The courts of the State of New York have jurisdiction over any dispute.

If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose law gives you the right to bring proceedings in your own courts and to the protection of your own country’s mandatory consumer law, that right is unaffected by the paragraph above.

If any part of these terms is held unenforceable, the rest continues to apply.
